Notes on 1870 Grayson Co. VA census. (origin?)
Samuel Blevins was s/o John Blevins and Catherine Cox. John Blevins,Sr. came to America with the British Army during the AmericanRevolution and relinquished his British citizenship and in so doinglost his title to real estate in Halifax, Nova Scotia. Samuel, above, sought to reclaim the estate and was denied any right to it.
John Blevins was discharged from the British Army on 11/7/1783 anddied
on 8/10/1816 and was buried in a family cemetery near Delhart onLittle River.
1884 - Letter from British Consulate to Samuel Blevins
No. 1, Murray Street
New York, NY
April 10, 1884
Mr. Samuel Blevins
Dear Sir:
In reply to your favor of March 31st with the enclosed five dollars, office
fee, Thanks. I have examined the Books and papers of my office library
relative to the supposed claim of your father John Blevins, formerlyof Halifax,
N.S. who was four years serving in the British Army, under Lieut. Col.
Commanding John Hamilton, in the North Carolina Regiment of the Crownand was
discharged Nov. 7th, 1783 at the peace between America and England. The said
John Blevins, acknowledged on his discharge paper to have received allpay,
arrears, clothing and of all demands whatsoever, from the BritishCrown. If your
father John Blevins had then returned to England or Halifax andremained
there, he would then have been a British Subject and would have beenentitled to
a pension from the British Crown. But as your father, after the War of
1780, remained in the United States and died there in 1816, he becamea citizen
of the U.S., all claim to pension from the Crown was forfeited by thelaw of
England. And had he ever been entitled to a pension, it would ended atthe
death of Catherine his wife in Janry. 1843. You are barred by Law ofEngland
on this pension claim.
Secondly you state that your father John Blevins was the owner of somelots
of land in Halifax, NS. where the town now is built, and left in thecare of a
person name Paul. This land was left by your father over one hundredyears
ago and since that time many new laws have been posted in the City of
Halifax, N.S., and in other parts of Canada. In the year 1836, a lawwas past for
Halifax, New Brunswick and all sovereign Canada, colony of GreatBritain as
a Statute of Limitations law (relative) to real estate in lowerCanada, that
21 years adverse possession by any person on lands, without beingmolested by
any person or persons, should constitute a (valid) title in feesimple.
Your father and you have let your claim sleep too long. Your arebarred by law
in this land claim, and my best advice to you is never to pay out another
dollar on either of these claims as no benefit to you can result fromany
further expense.
I notice by my books that Samuel Blevins, and the widow of HenryBlevins
received pensions for services in the Revolutionary War. I am sorryyour claim
proves not to be a good one upon investigations.”
“Very Respectfully Yours
John F? Jayne?
P. S. I enclose the Discharge of John Blevins, 1783. JFJ"
From Robert Kirby Web site:
BIO:I HAVE A PHOTO COPY OF LETTER DATED 4/10/1884 FROM JOHN J JAYNE NO1 MURRAY ST.. NEW YORK TO SAMUEL BLEVINS ADVISING HIM THAT HE COULDNOT OBTAIN A PENSION SAMUEL THOUGHT WAS DUE TO HIS FATHER AS JOHN WASDUE. HE STATED THAT JOHN BLEVINS, FORMERLY OF HALIFAX, N. S. = WHOWAS FOUR YEARS SERVING IN THE BRITISH ARMY, SERVING UNDER LIEUT. COLCOMMANDING JOHN HAMILTON IN THE NORTH CAROLINA REGIMENT FOR THE CROWNAND WAS DISCHARGED NOV 7th 1783 AT THE PEACE BETWEEN AMERICA ANDENGLAND. THE SAID JOHN BLEVINS ACKNOWLEDGED ON HIS DISCHARGE PAPER TOHAVE RECEIVED ALL PAY ARREARS, CLOTHING AND ALL DEMANDS WHATSOEVERFROM THE BRITISH CROWN. IF YOUR FATHER JOHN BLEVINS HAD THEN RETURNEDTO ENGLAND OR HALIFAX AND REMAINED THERE, HE WOULD HAVE THEN BEEN ABRITISH SUBJECT AND WOULD THEN HAVE BEEN ENTITLED TO A PENSION FROMTHE BRITISH CROWN, BUT YOUR FATHER, AFTER THE WAR OF 1780, REMAINED INTHE UNITED STATES AND DIED THERE, HE BECAME A CITIZEN OF THE U. S. ANDALL CLAIM FROM THE CROWN WAS FORFEITED. ANY CLAIM WOULD HAVE ENDEDWHEN CATHERINE, HIS WIFE, DIED IN JAN'Y 1843. THE LAWYER WENT ON TOSAY THAT ANY CLAIMS TO THE LOTS HE OWNED WHERE THE TOWN OF HALIFAX ISNOW BUILT' WAS LOST OVER ONE HUNDRED YEARS AS MANY NEW LAWS HAD BEENENACTED, ECT. HE ADDED A POSTSCRIPT STATING THAT HE WAS ENCLOSING THEDISCHARGE OF 1783. I DID NOT FIND THIS DISCHARGE AMONG THE TRUNK OFPAPERS I WAS ALLOWED TO EXAMINE. J. G. K., JR.
Mrs. Robert Reeves--Dalhart community has old letter written toSamuel Blevins # 1263 (a son of John Blevins and Catherine Cox) by alawyer in Nova Scotia , advising him that it was too late to claim HisFathers lots in Nova Scotia for as John , Sr. had fought for theBritish in the Revolutionary War, the statute of limitations had runout many years ago and that his wife had been dead for a long timethere were no legal inheritors living that Samuel should save hismoney and forget as the lots had been sold a long time ago. RobertReeves has been dead for years. he was a grandson of Samuels Sister. She had many old documents which I copied or Photographed. His oldBible show him on page three of the family pages as Father, then thecaption John Blevins deceast 15th day of April in the year of Christ1816. His birth date was not in the family pages but the inside coverhad the old fashioned figured design and some writing that was nearlyobliterated by a homemade coarse cloth but with a magnifing glass Ithought I could read his name and date of 1727 or 37. JGK.Jr. This isnot stated as an absolute fact but the best estimation of the writing.
